Privacy notice
Last updated: November 2, 2026
This notice explains how we handle your personal data on solucionespresenciadigital.com, in the free website assessment and in the channels where you contact us (form, email, WhatsApp and social media). It is issued under Mexico's Federal Law on the Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de los Particulares) and related rules.
1. Data controller
Ivan Felix Valdes, an individual doing business under the trade name Soluciones Presencia Digital ("we"), is responsible for processing your personal data.
- Address: Saltillo, Coahuila, Mexico. The full address for legal notices is provided on request at the contact email.
- Privacy and ARCO contact: [email protected], handled directly by the owner.
2. Data we collect
We get it directly from you, when you fill in a form or write to us, and automatically, when you browse the site.
| Where | Data |
|---|---|
| Free website assessment | Name, company, website address, work email on the company's domain and, if you add one, a copy email. Also: your consent choices, IP address, browser type, date and time, and where the visit came from (for example, the campaign that brought you). |
| Contact form | Name, company, WhatsApp or phone, email (optional) and service of interest. Also: language, IP address, browser type, date and time, and the version of this notice in force when you sent it. |
| WhatsApp, email, calls and social media | Name, number or account, email, company, job title and whatever you tell us about your business so we can help you or quote. |
| Browsing the site | Technical and usage data from analytics cookies, only if you accept them. Details in the cookie policy. |
This is identification, contact and work data. We do not ask for sensitive personal data (health, religion, ethnic origin, preferences, etc.) or bank details on this site; please do not include them in your messages.
Copy email. It belongs to someone else at your company. By entering it you confirm you are authorized to share it. We only use it to send that copy of the report: it is not added to any list and we do not write to it afterwards.
Unverified email. We do not confirm that the assessment email is yours: we send the report to the address you typed. Only enter an email you use or are authorized to use.
The site is aimed at businesses and professionals. We do not knowingly collect data from minors.
3. How we use it
Primary purposes (needed to serve you)
- Run the automated assessment of the website you entered and email you the report (and the copy, if requested).
- Answer your messages and requests, prepare quotes and schedule calls or meetings.
- Follow up on your request, for example to answer questions about your report.
- Prevent abuse and protect the site: one assessment per website and per email every 30 days, bot filters and IP logging.
- If you hire us: prepare the proposal, contract and invoice, and deliver the service. That relationship is also governed by the contract.
- Comply with legal obligations and requests from authorities.
Secondary purposes (optional)
- Send you information, news, content and promotions from Soluciones Presencia Digital.
- Ask for your feedback through short surveys.
Secondary purposes need your consent: in the assessment you give it with a box that starts unchecked. If you leave it unchecked, you still get your assessment. Because the assessment email is not verified, before sending promotions we ask you to confirm in the first email, or we only write to people who replied or asked us for something.
If you do not want us to use your data for secondary purposes, tell us at any time at [email protected] or use the unsubscribe link in every email. Saying no does not affect the service you asked for.
4. Automated assessment
The assessment is done by an automated system. It reads the public pages of the website you entered, measures its speed with Google PageSpeed Insights and uses the OpenAI API (artificial intelligence) to write the analysis. We only send those services the address and public content of the website, never your name or email.
The result rates the website, not you or your company, and has no legal effect on you. If you want a person to review your report or have questions about it, write to us.
5. Service providers and transfers
We use providers that process data on our behalf and only to provide their service to us (processors). Some process it outside Mexico:
| Provider | Purpose | Location |
|---|---|---|
| HostGator (Newfold Digital) | Website hosting, assessment and contact form databases, and email | United States |
| OpenAI | Analysis of the website's public content (no personal data) | United States |
| PageSpeed Insights (public website data), Google Analytics and spreadsheets to track requests | United States and other countries | |
| Cloudflare | Bot filter (Turnstile) on the assessment form | United States and other countries |
| Make (Celonis) | Passing each request to our tracking sheet | European Union and United States |
| Meta Platforms | WhatsApp Business, Facebook and Instagram messages, and the Meta pixel (only if you accept cookies) | United States and Ireland |
| Brevo | Sending information and promotional emails, only to people who agreed | European Union |
| OpenAI and Anthropic | AI tools that help us draft replies, proposals and reports. We avoid including your contact details in them | United States |
We do not sell or rent your data or transfer it to third parties for their own purposes. We would only share it without your consent where the law allows, for example when ordered by a competent authority or when needed to establish or defend a right in court.
6. How long we keep it
- Assessment: 12 months from the request. It is then blocked and deleted from the database, and the deletion is logged.
- Copy email: until the copy is sent, for 30 days at most.
- Contacts and quotes that do not go ahead: 12 months from the last message.
- Promotional list: until you unsubscribe; you are removed immediately.
- Clients: for the length of the relationship and then for the period required by tax and commercial law (generally 5 years).
7. ARCO rights
You have the right to access your data, rectify it if it is inaccurate, cancel it (ask us to delete it) and object to its use for specific purposes. To exercise them, email [email protected] with the subject "ARCO rights" and include:
- Your name and the email or channel where you want the answer.
- A copy of your official ID or, if acting for someone else, proof of representation.
- Which right you want to exercise and over which data, clearly described.
- Anything that helps us find it (for example, the website and date of the assessment). For a rectification, state the change and attach supporting documents if needed.
We will answer within 20 business days of receiving the complete request. If it is granted, we will carry it out within the following 15 business days. If information is missing, we will ask for it by email and the period will run from when we receive it. The process is free; only justified shipping or copy costs could apply. If you cancel your data, we also delete it from our providers' tools where it is stored (for example, the mailing list).
8. Withdrawing consent or limiting use
You can withdraw the consent you gave us at any time, following the procedure in section 7 (subject "Withdrawal"). Withdrawal is not retroactive and, if it concerns a primary purpose, we may no longer be able to handle your request.
To limit the use of your data: use the unsubscribe link in each email, or write to us asking not to be contacted through a given channel and we will add you to our internal exclusion list. You can also sign up for Profeco's Public Registry to Avoid Advertising (REPEP).
9. Cookies
We use Google Analytics 4 and the Meta pixel to measure site usage and our campaigns, only if you accept them in the cookie notice. You can change your choice with the "Cookie preferences" button at the bottom of every page. Full details are in the cookie policy.
10. Changes to this notice
If we change this notice we will publish it on this page, with the update date at the top. If a change adds purposes that require your consent, we will ask for it before using your data for them.
11. Authority
If you believe your right to personal data protection has been violated, you can go to the competent authority, which since 2025 is Mexico's Secretaría Anticorrupción y Buen Gobierno (Ministry of Anti-Corruption and Good Governance).
By submitting a form on this site you confirm that you have read this notice. This is a translation of the Spanish version, which prevails in case of any difference. See also the terms of use.
